Historic letter regarding Sheirut Leumi. Bnai Brak 1972.
Autograph letter by R. Shach with additional signature by the Steipler written to R. Immanuel Jakobovits, Chief Rabbi of Britain and the Commonwealth. They urge him to utilize his influence, both on a public and private level to assist in the case against mandatory Sheirut Leumi.
In 1972, the Israeli government, sought to pass a law forcing all girls who received a religious army deferment, to enlist for two years in Sherut Leumi (national service in a civil non-military setting). The leading Torah authorities of the time, ruled that this was halachicly forbidden, and included in the category of the three cardinal sins in respect of which one is obliged to sacrifice one’s life rather than to transgress them. The Gedolim explained that any custodianship over a girl, other than that of her parents or husband, is considered immoral and is strictly forbidden. The conflict which ensued was one of the biggest battles fought by the Charedim in modern Israel. Eventually, the Charedim prevailed and the law was not implemented.

מכתב אוטוגרפי שכתב הר’ שך, עם חתימה נוספת של הסטייפלר, לר’ עמנואל יעקובוביץ, הרב הראשי של בריטניה. הם קוראים לו לנצל את השפעתו, הן מהבחינה הציבורית והן מהבחינה הפרטית, כדי לסייע בתיק נגד חובת שירות לאומי.
בשנת תשל’ב (1972) ביקשה ממשלת ישראל להעביר חוק המחייב את כל הבנות שקיבלו דיחוי שירות צבאי מטעמי דת להתגייס לשנתיים של שירות לאומי (בסביבה אזרחית ולא צבאית). אולם, גדולי התורה של אותה תקופה פסקו שגיוס זה אסור על פי ההלכה וכלול בקטגוריה של שלושת העבירות החמורות שעליהן נאמר “ייהרג ואל יעבור”. הם הסבירו שכל אפוטרופסות על נערה מלבד זו של הוריה או של בעלה נחשבת לבלתי מוסרית ואסורה באיסור חמור. הממשלה החילונית נלחמה בעוז כדי לחוקק את החוק. העימות שנוצר היה בין המלחמות הקשות ביותר של החרדים בישראל המודרנית. עם הזמן, החרדים ניצחו והחוק לא יצא לפועל.
