Manuscript of the Megilas Eivah by the Tosfos Yom Tov, handwritten by an unknown writer. This work was first published in Breslau, 1837. Prior to that it existed only in manuscript form. The manuscript before us contains some variations to the printed version.
Born in Wallerstein, Bavaria in 1578, R. Yom Tov Lipmann Heller is known as the Tosfos Yom Tov after his major commentary to the Mishnah. In his youth he learned in Prague with both R. Yehuda Loewe (MaHarAL) and R. Ephraim Lunschitz (Kli Yokor) and at the early age 19 he joined the Bais Din of the MaHarAL. In 1627, he was appointed Chief Rabbi of Prague.
As a result of the ongoing Thirty Years’ War (1618-1648), the Jews of Bohemia were heavily taxed. As Chief Rabbi, the Tosfos Yom Tov decided that the wealthier members of the Jewish community should shoulder a larger share of the financial burden. Unfortunately, in response, certain wealthy Jews joined forces with government and Church officials to prosecute him. In the summer of 1629, the Rav was arrested by the Imperial Court of the Holy Roman Emperor, Ferdinand II, and charged with insulting Christianity in his rabbinic works Ma’adanei Melech and Lechem Chamudos. After intense lobbying on the Rav’s behalf by various political and communal leaders in both Prague and Vienna, the Emperor commuted the sentence to forty days imprisonment in Vienna, along with a heavy fine. Furthermore, the Tosfos Yom Tov was forced to relinquish his rabbinical position in Prague.
The Tosfos Yom Tov wrote a chronicle of the entire ordeal, including his arrest, trial, verdict and incarceration, in “Megilas Eivah”. Additionally, he instituted a fast day for his descendants on the anniversary of his imprisonment (5th Tammuz), as well as an annual celebration (1st Adar) on the day he won back his freedom and status following his nomination to the Cracow Rabbinate. Centuries later, many of his distinguished descendants still commemorate these events.
In this work, the Tosfos Yom Tov writes that if one is in the midst of a “tzarah” (crisis), learning this sefer will be a segulah for salvation.

כתב יד של מגילת איבה של התוספות יום טוב, בכתב יד של מעתיק לא מזוהה. חיבור זה נדפס לראשונה בברסלוי תקצ”ז 1837, ועד אז הועתק רק בכתב יד. בכתב היד הנוכחי ישנן מספר שינויים מהטקסט המודפס.
ר’ יום טוב ליפמן הלר המכונה התוספות יום טוב על שם פירושו הענק למשנה נולד בוולרשטיין שבבוואריה בשנת של”ח (1578). בצעירותו למד בפראג אצל ר’ יהודה לווי (המהר”ל) ור’ אפרים לונשיץ (כלי יקר). בגיל 19 כבר היה חלק מבית דינו של המהר”ל, ובשנת שפ”ז (1627) התמנה לרב הראשי של פראג.
כתוצאה ממלחמת שלושים השנים המתמשכת (שע”ח- ת”ח, 1618-1648), חויבו יהודי בוהמיה בתשלומי מיסים כבדים. מתוקף תפקידו כרב הראשי, קבע התוספות יום טוב כי עשירי הקהילה היהודית ייטלו על עצמם חלק גדול יותר מהנטל הכספי. לרוע מזלו, חברו מספר יהודים עשירים מהקהילה, יחד עם גורמים ממשלתיים ועם הכנסייה להעמידו לדין, כתגובה לפסיקתו. בקיץ שפ”ט (1629) נעצר הרב על ידי בית הדין הקיסרי של הקיסר הרומי הקדוש, פרדיננד השני, והואשם בגינוי הנצרות בספריו הרבניים מעדני מלך ולחם חמודות. לאחר שתדלנות אינטנסיבית למען הרב מצד מנהיגים פוליטיים וקהילתיים שונים בפראג ובווינה, המיר הקיסר את העונש לארבעים ימי מאסר בווינה, וכן קנס כבד. יתר על כן, נאלץ התוספות יום טוב לוותר על מעמדו הרבני בפראג.
התוספות יום טוב כתב חיבור על כל השתלשלות העניינים, כולל מעצרו, משפטו, פסק הדין וכליאתו, בספר “מגילת איבה”. בנוסף קבע יום צום לצאצאיו ביום השנה למאסר (ה’ בתמוז), וכן יום חג שנתי (א’ באדר) שזהו היום בו זכה בחירותו ומעמדו בעקבות מינויו לרבנות בקראקא. גם מאות שנים לאחר מכן, רבים מצאצאיו הנכבדים עדיין מציינים את ימי האירועים הללו.
בחיבורו זה כותב התוספות יום טוב כי אדם הנמצא בעיצומה של צרה, ילמד בספר זה ויהיה לו לסגולה וישועה.
