During the British Mandate a bitter fight arose for control of Jerusalem’s Jewish community between the “Old Yishuv” and the Zionist movement. To settle the issue, the Mandatory authorities ordered a vote. Aware that the Old Yishuv would not allow their women to vote, the Zionist and Mizrachi organizations urged all of their own women to vote, in an underhand effort to win this historic battle.
This Psak Din issued in 1920 by the Eidah Ha’Chareidis forbids women to serve in a communal position or to vote. This therefore called into question the validity of the election, which resulted in control of the communal infrastructure (including the rabbinate), passing to the new Yishuv. The echoes of this epic struggle remain prevalent today.
This is very shortly after the founding of the Eidah Ha’Chareidis and is signed by the Ga’avad: R. Yosef Chaim Sonnenfeld, Ra’avad: R. Nochum Vallerstein, (previously of the Perushim Bais Din) and the Dayanim R. Mordechai Leib Rubin and R. Yitzchok Frenkel.

בתקופת שלטון המנדט הבריטי בארץ ישראל, התנהל מאבק מר בין “הישוב הישן” לבין התנועה הציונית על השליטה בקהילה היהודית בירושלים. כדי ליישב את המחלוקת, הורה שלטון המנדט על הצבעה. בהיותם מודעים לכך שב”יישוב הישן” לא יאפשרו לנשים להצביע, דרבנו בארגונים הציוניים והמזרחיים את כל הנשים להצביע, במאמץ עילאי לנצח במאבק ההיסטורי הזה.
פסק דין זה שיצא בתר”פ (1920) על ידי העדה החרדית אוסר על נשים לשרת בעמדה קהילתית או להצביע בבחירות קהילתיות, ובכך מאפשר את העובדה שיתכן שהיישוב החדש ישתלט על המוסדות הקהילתיים, כולל הקמת הרבנות. הדי מאבק אפי זה רווחים עד ימינו.
המסמך נכתב זמן קצר מאוד לאחר היווסד העדה החרדית, חתומה בידי הגאב”ד: ר’ יוסף חיים זוננפלד, הראב”ד: ר’ נחום וולרשטיין, (לשעבר מבית דין הפרושים), והדיינים- ר’ מרדכי לייב רובין, ור’ יצחק פרנקל.
